Litigation

When efforts to resolve a business dispute are unsuccessful, the next step may be taking the case to court. Litigation is both distracting and expensive for a business, so my goal is always to handle the case aggressively and efficiently. I bring more than 20 years of litigation experience both prosecuting and defending cases ranging in scale from small matters to contractual disputes worth millions of dollars. Because my practice areas include both business services and litigation, I have a unique ability to understand the elements of the deal that can give rise to the greatest threat of litigation – and negotiate accordingly to reduce the overall cost of negotiation and the threat of ending up in court.

Case Study: After working together well for many years, my client began to have trouble with his business partner. She had begun acting strangely and failing to take care of her obligations to the business.  After meeting with my client, I began an investigation and discovered that the partner had embezzled many hundreds of thousands of dollars from the business. We first tried to resolve the issue privately. When that failed, we filed suit against the partner and were able to recover all the money that was missing from the company. We also negotiated a full settlement between the parties that met my client’s expectations and ended the dispute on a positive note. Throughout the process, I kept my client informed, outlined a roadmap for next steps, and proved clear, simple bills that allowed them to control costs and plan for the next phase of litigation.

Case Study: When long-time business partners decided to end their business relationship, I was able help them reach an equitable, cordial, and cost-effective resolution via mediation. In my role as a neutral mediator, I helped both partners discuss their outstanding issues and begin crafting a solution that met both of their desires and needs. After a day and a half of mediation sessions, I was able to resolve the uncertainty in this major area of their lives by using what they’d discussed to draft a mutually satisfactory agreement outlining each partner’s rights and obligations. Throughout the process, they were able to remain focused and constructive and part ways for a fraction of the cost they would have incurred if they’d gone into litigation.

Mediation

Mediation is often a far less expensive and a less time-consuming option than litigation for resolving disputes. In mediation, I serve as a neutral third person to help you and the other party or parties discuss the issues surrounding the dispute and explore ideas for resolution. As a mediator, I do not have the power to decide how your case will be resolved, but I can help you reach a mutually acceptable resolution. I can also draft a copy of that agreement to prevent future disputes.
